Rodriguez's 27-year-old daughter, Ingrid Ortiz, has toxoplasmosis cerebral palsy. Rodriguez said she was granted a loan modification and began making payments but then the bank sent her checks back and sold her home at a foreclosure auction in September.

Bank of America Spokesman Rick Simon said the bank lost control of the eviction process after it sold the foreclosed house to West Ridge Rentals. He said that West Ridge has agreed to stop the eviction so the bank can work with Rodriguez.

"Once we are able to rescind the foreclosure sale and return the loan to our servicing portfolio, we look forward to finding a long-term plan that will suit the needs of the Rodriguez family," Simon said in a statement.
