I have a legal identity question
PostPosted: Thu Mar 31, 2011 10:28 pm Reply with quoteBack to top

If one travels overseas for a period of time as a child with a single/divorced parent who remarries the child is adopted and has a legal name change then comes back to the US years later and starts signing things(loans(personal/student), DL, financial aid, medical etc) by their birth name vs their legally changed name where does the law lie?

If a woman marries changes her last name to her husbands name which name is legal, her married or maiden name? In this example lets assume all associated accounts, loans etc are in her married name.

Can one use their mothers maiden name to sign for loans(personal/student), DL, financial aid, medical etc even though the name on all their accounts DL etc is their birth name. Example birth name is John Doe, son of Mom Doe (formerly Homemaker) John starts signing documents etc etc as John Homemaker, is this legal?

In most states you have to petition the courts for a name change.

It used to be that you can effect a name change, simply by starting to use that name, but now it needs to be court petitioned.

With a minor, most of the time, both parents need to be notified/agreeable to the name change.

So, the child cannot simply start signing a new name to everything.

Even if a person does change their name, and gets a new birth certificate, they still will have a problem with Social Security. I don't know why there is so much fuss about this issue with SSA ... they had no problem with illegals doing exactly the same thing. (but that's a whole nutha .... )

Question to the situation you described, about overseas minor.

Is that minor, Obama by any chance? JK

How did the Minor return to the country? What documentation? What did their passport state as the legal name?
