Is it fair to say that a warranty is not really a warranty if a builder is trying to repair a shoddy home, puts the family out of the home for a few days, agrees to reimburse the family, however builder hand carries a check for the cost of 8 days, but tells the homeowner to sign a legal letter giving up rights to speak about issues with KB? Letter also says homeowner agrees not to make information public in anyway. If homeowner does not sign the legal letter, then homeowner wont be given the check.


Can this be considered a violation of a consent order?

You should probably report that to the FTC since KB's your builder. I think they are the only builder subject to a government consent decree that covers their actions with consumers. It also can't hurt to alert the local media; particularly if you have pictures and other evidence.

I suggest you take your case to those who can act on the evidence. We only hear your statements and have no way of discerning the truth. I want to believe that there is a sense of honesty & integrity in those still in command at KB. Surely they are not insouciantly ignoring a court order. They have lawyers looking over their shoulder with the sole purpose of keeping their historically unfavorable proclivities in check. It would certainly be easier, less expensive and better from a marketing perspective, to obey the law and to convert the naysayers with acts of goodwill and fair play.

The person should indeed contact the FTC. However, though it seems like self destructive behavior for a company to engage in these practices, it has become profitable to cheat. Fines and lawsuits are treated as if they were fees one had to pay to get a building permit, not as punishments for wrong acts. Violating consent decrees, etc, is common, inlcuding for KB who has been doing it for years.

Because of the expenses businesses can write off, legal fees and the like don't much affect the company's bottom line, especially a company of this size.

Sure, EVENTUALLY, bad business practices can take down even a big company, but it can take years and leave a trail of broken customers. And the more cheating is accepted businedss practice, the more businesses do it, and the more the honest ones fail because they can't compete. If only the public knew what was going on in time to refuse to buy from these co's, but most of the bad news is under wraps, thanks to cowed media and arbitration clauses.

Let's be honest. KB treats its customers the same way it treats its employees.
Why do pople still work there or buy their homes?
Desperation and rock bottom prices.
